1. Introduction

These Terms of Service ("Terms") govern your use of the FundedList website, services, and communications operated by Wints LLC ("we," "us," or "our"). By accessing our website, subscribing to our services, or opting in to receive communications from us, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Description of Services

FundedList provides weekly lead generation reports containing recently funded startup CEO contact information, delivered to marketing agencies, B2B service providers, and other business professionals.

Our services may include report delivery via email, account notifications, promotional offers, and customer support communications sent through email, SMS/text messaging, and phone.

3. SMS/Text Messaging Program

3.1 Description of SMS Use Cases

By opting in to our SMS/text messaging program, you may receive the following types of messages from FundedList:

Message frequency varies based on your subscription and interactions with our services. You may receive up to 10 SMS/text messages per month. Promotional messages will be sent no more than once per week unless you have requested additional communications.

3.3 Message and Data Rates

Standard message and data rates may apply to any SMS/text messages you send to or receive from FundedList. These charges are determined by your wireless carrier and are your sole responsibility. Please contact your carrier for details about your messaging plan.

3.4 Opt-Out Instructions

You may opt out of our SMS/text messaging program at any time by replying STOP to any message you receive from us. After opting out, you will receive a single confirmation message and will no longer receive SMS/text messages from FundedList.

Opting out of SMS does not affect other communication channels (email, phone) unless you separately opt out of those as well.

3.6 Carrier Liability Disclaimer

FundedList and its affiliated entities, including Wints LLC, are not liable for any delays, failures to deliver, or errors in SMS/text message transmission. Wireless carriers are not responsible for delayed or undelivered messages.

Neither FundedList nor any participating wireless carriers shall be liable for any damages arising from or related to the SMS/text messaging program, including but not limited to direct, indirect, incidental, special, or consequential damages.

Supported carriers may include, but are not limited to, major U.S. carriers. Carrier participation and availability are subject to change without notice.

4. Eligibility and Age Restriction

Our services are intended for individuals who are at least 18 years of age. By using our website, subscribing to our services, or opting in to receive communications, you confirm that you are at least 18 years old.

We do not knowingly collect information from or market to individuals under the age of 18. If we learn that someone under 18 has enrolled in our services, we will immediately terminate their access and delete their information.

5. User Accounts and Subscriptions

You are responsible for maintaining the confidentiality of any account credentials and for all activity that occurs under your account. You agree to provide accurate, current, and complete information when registering or subscribing, and to update that information as necessary.

6. Acceptable Use

You agree not to use our services for any unlawful purpose or in any way that could damage, disable, or impair our services. You may not resell, redistribute, or sublicense any lead data or reports provided by FundedList without our prior written consent.

7. Intellectual Property

All content, reports, data compilations, branding, and materials provided through FundedList are the property of Wints LLC and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use purchased reports for your own internal business purposes only.

8. Payment and Refunds

Pricing for our services is as listed on our website at the time of purchase. All payments are due at the time of subscription or order. Refund requests will be considered on a case-by-case basis. Please contact support@fundedlist.com for any billing inquiries.

9. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee the accuracy, completeness, or timeliness of any lead data or reports. While we make reasonable efforts to provide accurate contact information, we are not responsible for data that may be outdated or incorrect.

10. Limitation of Liability

To the maximum extent permitted by law, Wints LLC and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services, including but not limited to loss of profits, data, or business opportunities.

11. Indemnification

You agree to indemnify and hold harmless Wints LLC from any claims, damages, losses, or expenses arising out of your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.
